Venue in Personal Injury Law Such As Auto Accident Cases- 803-252-1800
Monday, March 26th, 2012Managing Medical Care in Workers’ Compensation Cases
Tuesday, January 3rd, 2012In a workers’ compensation case, sometimes the injured worker cannot get his employer to designate an authorized treating physician. We will tell him typically to ask his employer where they want him to go, and if they refuse to name one, or try and stall, we tell the client to go to an emergency room, an urgent care facility, or their family doctor to seek whatever urgent care is needed. We will then send the bill to the insurance company for payment.
If you need help with a possible claim or case, call us today at 803-252-1800
Man Injured at Oil Change Facility – Personal Injury Lawyer
Tuesday, January 3rd, 2012
Personal injury lawyers like myself see everything! And accidents can happen anywhere.
I talked to a man recently who was injured in a local oil change store when they brought him into the garage to check out the car. I haven’t done my investigation yet, but I would think that violates the procedure, as most of these places have “No customers behind…” certain designated areas signs. A personal injury attorney such as myself will need to know what the procedures were, and was their negligence in causing this
injury.
Statute of Limitations in Personal Injury Claims in SC and GA
Thursday, December 29th, 2011One thing we accident attorneys have to be very careful with is the statute of limitations of our cases. When I take in a new case, I assign it the appropriate statute of limitations, and my paralegal logs it in. We keep an update SL calendar, and also have current SL lists. If a statute of limitations is approaching, we make sure the claim or lawsuit is filed. This is for both workers’ compensation and personal injury/auto accident cases.
Workers’ Compensation Attorney – Specialist 803-252-1800
Tuesday, December 6th, 2011I just had a workers’ compensation case where the client had seen a couple of specialists, neither of which could get to the root of his problem. So he paid his own way to a reputable surgeon who wrote a good convincing report. As the workers’ compensation lawyer, I forwarded the report on to the insurance carrier, and they have agreed to accept this new doctor as the authorized treating physician.
Slip and Fall Accident In Store- Personal Injury Case?
Tuesday, December 6th, 2011I just fielded a call from a man who was walking into a store, and mopping was going on, causing the man to slip and fall. The mopping was not marked, so no warning was given. This may be a case of liability, but I told him I’d like to know some more about his injuries before investing the resources to take the case. Slip and fall cases are more challenging for personal injury lawyers, so we have a different threshold for the injuries.
Workers’ Compensation Benefits – Auto Accident Analysis
Tuesday, December 6th, 2011Here’s an example of the complications of an auto accident paired with an on-the-job injury.
I just talked to a gentleman who was on the job when his truck slid out of control in a one-vehicle accident. Unfortunately, since is an independent contractor, as opposed to an employee, he is not eligible for workers’ compensation benefits. In order for WC to apply, you must be an employee. And since no other vehicle was involved, there’s not a third party liability claim. Workers’ compensation lawyers go through this kind of analysis all the time.
Lost Finger – Workers’ Compensation Injury Claim
Tuesday, December 6th, 2011Here’s a recent call I received for a workers’ compensation claim:
I received a call from a woman who had part of her finger chopped off at a local factory. Unfortunately, the workers’ compensation statutes do not allow a tremendous recovery for the loss of a finger. For example, the loss of an index finger only results in 40 weeks of compensation. We injury lawyers sometimes have a tough time getting that across to our clients, but we can only recover what the law allows.
Complexities in Workers’ Comp Cases – 803-252-1800
Friday, November 11th, 2011Sometimes in a workers’ comp case, we’ll get treatment approved for our client with a specialist such as an orthopedist, but they won’t see the client for all of the injured body parts. The insurance company may approve treatment for the knee for example, but not the back. This can result in a real headache, because what’s really bothering the client is not getting checked out. this results in a lot of phone calls and paperwork for the workers’ compensation attorney.
Car Accident Attorney in Columbia, SC – 803-252-1800
Friday, November 11th, 2011I received a call today from a woman who had been injured rather severely in a car accident, and was handling negotiations with the insurance company herself. The liability limits are low, and she has started talking to her own underinsurance carrier. I explained to her that if she signed a release with the at fault driver, she would be forfeiting her claim for underinsured motorist benefits. She really needs an auto accident lawyer to look things over for her.
