If we have to file suit, we have to go to the county where the accident happened or the defendant resides. There are certain counties in South Carolina that have particularly conservative jury pools, such as Lexington County. An accident attorney such as myself does not want to see his case tried in Lexington County typically. Unfortunately, we don’t have a lot of choice sometimes.

One thing we accident attorneys have to be very careful with is the statute of limitations of our cases. When I take in a new case, I assign it the appropriate statute of limitations, and my paralegal logs it in. We keep an update SL calendar, and also have current SL lists. If a statute of limitations is approaching, we make sure the claim or lawsuit is filed. This is for both workers’ compensation and personal injury/auto accident cases.

I just fielded a call from a man who was walking into a store, and mopping was going on, causing the man to slip and fall. The mopping was not marked, so no warning was given. This may be a case of liability, but I told him I’d like to know some more about his injuries before investing the resources to take the case. Slip and fall cases are more challenging for personal injury lawyers, so we have a different threshold for the injuries.

I received a call today from a woman who had been injured rather severely in a car accident, and was handling negotiations with the insurance company herself. The liability limits are low, and she has started talking to her own underinsurance carrier. I explained to her that if she signed a release with the at fault driver, she would be forfeiting her claim for underinsured motorist benefits. She really needs an auto accident lawyer to look things over for her.

My heart just breaks when I read about incidents like this. As a personal injury lawyer, we see and hear and read too much about these types of incidents. If an accident attorney gets involved in this case, he/she is going to possible do a scene reconstruction, talk to all available witnesses, possibly hire an expert or two, and really work this up to the hilt. If the driver was negligent in any way, the family needs to know about it and possibly make a recovery.

“Columbia man dies”
We personal injury lawyers hate it any time we read someone dies in an auto accident. As car accident attorneys, many times we are hired by a family to pursue a wrongful death case. In this accident, since it was a one-car accident, there wouldn’t be anything a wrongful death attorney could do, as there is no one to bring a claim against. Unfortunately, this is just another in the tragic statistics on our nations’ roads.

If the at fault driver is on the job at the time of the car accident, his employer can be held liable for the damages. A personal injury lawyer is always going to ask whether the defendant was within the course and scope of his employment at the time of the accident for just this very purpose. A lot of times, the insurance coverage for the employer is a lot better than the driver’s own personal coverage.

Because so many accidents happen in cars, many of our clients view us as car wreck attorneys or auto accident lawyers.
Motorcycle accident claims are really just another variety of a car accident claim. Some of the fact situations are unique, but the vast majority of issues: right of way, speed, and other issues of negligence, are the same. I do find that when a person gets in a wreck while on a motorcyle, the injuries tend to be worse, so do what you can to avoid that accident in the first place!
